(PatriotNews.net) – Former President Donald Trump has been indicted again, this time for allegedly trying to overturn the results of the 2020 presidential election. Special Counsel Jack Smith filed the new charges on Tuesday, reshaping an earlier case to fit with a recent Supreme Court decision. The ruling granted former presidents immunity for official acts, so Smith had to change the original indictment to follow the law.
The new indictment keeps the same charges but removes parts that accuse Trump of using his role as president to pressure officials, including those from the Department of Justice (DOJ). One major change involves Trump’s conversations with Mike Pence, who was vice president at the time. The focus is now on Trump’s actions as a presidential candidate rather than as a sitting president.
Trump still faces charges of conspiracy to defraud the U.S., obstruction of an official proceeding, and conspiracy against rights. He has pled not guilty to all of them. The special counsel claims Trump tried to recruit fake electors in key states to declare that he had won. They also say he pressured Pence to reject valid electoral votes on January 6, 2021.
This revised case was filed just before a deadline for Smith’s office to update the court. It comes as a new grand jury looks into the fresh evidence presented. Interestingly, this new indictment no longer names Jeffrey Clark, a former top DOJ official who had supported Trump’s claims of election fraud, as a co-conspirator. In the original indictment, Clark was key in a plan to send a letter to state officials questioning the election results.
Trump responded to the new charges by posting on Truth Social. He claimed that these legal moves are attempts to interfere with the upcoming 2024 presidential election. He specifically blamed Democrats and said this was part of a larger effort to hurt his chances of winning.
Despite the new indictment, sources say it’s unlikely that this case will go to trial before the 2024 election.
